The purpose of these General Terms and Conditions of Use (hereinafter referred to as the “GTCU”) is to define the terms and conditions for accessing and using the information and services offered on the www.tipsychologyhealth.com website (hereinafter referred to as the “Site”).

By accessing and using the Site and its content, you (hereinafter the “User”) accept and agree to abide by the GCU, as well as the specific conditions applicable to certain services.

The Training Institute for Psychology & Health (TIPH) reserves the right to adapt or modify these GTC at any time. In the event of modification, reference will be made to the GCU in force on the day of connection to the Site. The User is therefore invited to consult the GCU on a regular basis in order to keep abreast of the most recent changes.

ARTICLE 1 – PRESENTATION

The Site contains various information and services that are provided by TIPH (hereinafter, collectively, the “Services”):

  1. Information on training courses offered by TIPH ;
  2. Links to the platform where these courses can be ordered;
  3. Subscribe to the TIPH newsletter.

ARTICLE 2 – OBLIGATIONS OF THE USER

The User undertakes to comply with the GCU applicable to the Services offered, in addition to all applicable laws and regulations.

The User shall refrain from any fraudulent, abusive or excessive use of the Site and/or the information and data it contains.

Without prejudice to the stipulations of article 5 (Intellectual Property), TIPH formally opposes any use by a User or any third party of the information appearing on the Site to provide a directory service to the public. TIPH has not entered into any partnership agreement with companies publishing websites offering this type of service and warns its visitors against the unfair practices of these third parties and the total absence of any guarantee provided by TIPH regarding the information published by these third parties.

Users undertake not to use the Site and the Services offered therein for fraudulent or illegal purposes, and in particular in a manner that :

  1. contravenes public order or morality, in particular by consulting or disseminating elements such as (this list is non-exhaustive and not limited to) pornography, pimping or paedophilia, or violent content, the content being likely to be seen by minors;
  2. has the character of a call to murder, incitement to racial hatred or denial of crimes against humanity;
  3. contravenes the legitimate interests of TIPH or any third party, in particular by way of insult or defamation, or infringes privacy, personality rights or property or extra property rights;
  4. consists of acts of piracy, whatever their form (intrusion into systems, propagation of viruses, spamming, etc.).

ARTICLE 3 – LIABILITY – LIMITATIONS

TIPH does not guarantee that the Site and the Services offered therein are free of anomalies, errors or bugs, or that these can be corrected, or that they will function without discontinuity, breakdowns or interruptions, or that they are compatible with the User’s equipment or configuration. The User is aware of the characteristics and limits of electronic communications networks, in particular their technical performance, response times for consulting, querying or transferring data and the risks associated with the security of communications.

TIPH is in no way responsible for malfunctions attributable to third-party systems or software or to force majeure. TIPH may not be held liable for any foreseeable or unforeseeable damage, material or immaterial (including loss of profits or opportunity…) arising from the use or total or partial impossibility of using the Site or any of the Services or functionalities offered directly or indirectly by them.

The Site is normally accessible at all times. However, access may be suspended or withdrawn at TIPH’s discretion, in particular in the event of force majeure, computer difficulties, difficulties related to the structure of telecommunications networks, technical difficulties, or for maintenance reasons, without this list being exhaustive.

TIPH is bound only by a simple obligation of means concerning the information and/or Services it offers Users via the Site.

TIPH makes every effort to ensure the reliability of the information provided on the Site, but cannot guarantee its accuracy, precision or completeness.

Consequently, the User acknowledges that he/she uses this information under his/her own responsibility.

ARTICLE 4 – PERSONAL DATA

The information that the User communicates on the Site enables TIPH to respond to requests for information and to reply to requests by email. Browsing the Site may cause cookies to be installed on your computer. They simplify your visit to the Site. The purpose of the cookie is to indicate the User’s visit to the Site in order to improve the personalized service provided to Users. The User may refuse the installation of cookies on his or her computer, but such refusal may prevent access to certain Services.

For complete information on the processing of personal data, TIPH invites the User to consult its Privacy Policy, available on the site and in which are specified:

  1. The legal basis for the processing of personal data collected ;
  2. Types of personal data collected ;
  3. How long personal data is kept ;
  4. The purposes of the processing of personal data collected ;
  5. Personal data shared by TIPH with other companies.

In accordance with the Privacy Policy, the User may at any time :

  1. Oppose the processing of personal data for legitimate reasons;
  2. Access, modify and rectify personal data;
  3. Request the portability of personal data;
  4. Request a limitation of TIPH treatments.

In addition, the User has the possibility of communicating directives concerning the conservation, deletion and communication of his/her personal data after his/her death.

In addition, the Cookie Usage Policy details TIPH’s policy on the use of cookies and in particular:

  1. The definition and purpose of a cookie ;
  2. The list of cookies issued by the Site ;

  4. How the User can express his/her choices concerning cookies.

ARTICLE 5 – INTELLECTUAL PROPERTY

The Site as a whole and each of its components (such as texts, databases, tree structures, software, animations, images, photographs, illustrations, diagrams, logos, sounds, music) are protected by intellectual and industrial property rights and other private rights held by TIPH.

TIPH is the sole owner of all intellectual property rights relating to the Site which belong to it or for which it holds the related usage rights. Access to the Site does not confer on the User any intellectual property rights in respect of the Site or its component parts.

Consequently, in application of the legal provisions concerning intellectual property and international conventions, it is forbidden to represent, reproduce, modify, publish, adapt or exploit all or part of the Site or its component parts on any medium whatsoever, by any means whatsoever, for any purpose other than the User’s personal and private use for non-commercial purposes, without prior written authorization from TIPH.

Violation of these provisions exposes the User to the penalties provided for by law, particularly with regard to copyright and trademark infringement and civil liability.

The trademarks, logos or domain names (such as TIPH, www.tipsychologyhealth.com, etc.) that appear on the Site are the exclusive property of TIPH. Any reproduction or use of these trademarks, logos or domain names, in any manner or for any purpose whatsoever, is prohibited.

Hypertext links to the Site may only be created with the prior written authorization of TIPH, which, if granted, may be revoked at any time without compensation.

ARTICLE 6 – THIRD-PARTY SITES AND/OR SERVICES

The Site may include links to other sites, sources and services. Insofar as TIPH cannot control these sites and other external sources, TIPH declines all responsibility for the content, advertising, products, services or any other material available on or from these sites or external sources. These links are provided solely for the purpose of facilitating the User’s browsing and access to information and services likely to be of interest.

ARTICLE 7 – APPLICABLE LAW AND JURISDICTION

The GCU are governed by Belgian law. Any dispute relating to the formation, interpretation and/or performance of these terms and conditions must, in the first instance and as far as possible, be settled by amicable negotiation between TIPH and the User. Failing amicable resolution within one month of notification of the dispute by one of the parties to the other, the parties acknowledge the exclusive jurisdiction of the competent Belgian courts to settle the dispute on the initiative of the most diligent of the parties.
